The Service has opened up a new employee plan compliance project. It’s eyeing 401(k)s that report multiple participants on Form 5500 but only one person with an actual account balance in the plan. The IRS is sending letters to plan sponsors in its quest to understand how these plans can meet the nondiscrimination rules. Plans that fail to respond to the questionnaire are likely to be subject to more scrutiny.
